29 CFR 1910.106(e)(6)(i): Adequate precautions were not taken to prevent the ignition of flammable vapors:  a.) Myers Trucking, Inc. 3158 Route 219 Kane, PA 16735, Shop Area, on or about 10/22/2025, and times prior thereto: Employees were exposed to fire/explosion hazards while performing hot work on the 6,300 gallon vacuum trailer #496. Employee was attempting to use an oxy-acetylene torch to remove a bolt from the valve at the rear of the trailer. The employer did not test the vacuum tanker to ensure no flammable material was present prior to the employee attempting to remove the rear valve.    ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation.  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement. IN ADDITION, abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic, or video evidence or abatement or other written records.

29 CFR 1910.252(a)(2)(vi)(C): Cutting or welding was permitted in the presence of explosive atmospheres (mixture of flammable gases, vapors, liquids, or dusts with air), or explosive atmospheres that could develop inside uncleaned or improperly prepared tanks or equipment which had previously contained such materials, or that could develop in areas with an accumulation of combustible dusts.  a.) Myers Trucking, Inc. 3158 Route 219 Kane, PA 16735, Shop Area, on or about 10/22/2025, and times prior thereto: Employees were exposed to fire/explosion hazards while performing hot work on the 6,300 gallon vacuum trailer #496. Employees were attempting to use an oxy acetylene torch to remove a bolt from the valve at the rear of the trailer. The employer permitted hot work to be conducted on the vacuum tanker without testing/verifying the vacuum tanker did not contain a hazardous atmosphere.   ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation.  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement. The employer's written hazard communication program did not include the methods used to inform employees of the non-routine tasks associated with hot work on vacuum trucks, and other equipment, which contained flammable liquids, gases, and/or residues.
