29 CFR 1926.416(a)(1):The employer permitted employees to work in close proximity to energized, unguarded, and ungrounded electric power circuits that the employee could contact in the course of their work: Location: Electrical duct bank below the Southern Artery near the intersection with Broad Street The employer allowed subcontractor employees to be exposed to up to 13.8 kV while jackhammering a 'live' electrical duct bank.

29 CFR 1926.1153(c)(1):For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, nor did the employer assess and limit the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section. Location: Excavation near the intersection of Southern Artery and Broad Street The employer allowed the dry chipping and jackhammering of a concrete duct bank and had not assessed silica exposures from this task.
