29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions:  On or before October 20, 2025, the employer did not ensure that a daily inspection of the trench was conducted prior to directing three employees to work inside a trench that was approximately 9 feet in depth, and 20 feet in length to install utility lines. A protective system was not utilized in the trench that had nearly vertical walls and spoils along each edge of the trench. One of the trench walls sloughed off, thus striking and trapping an employee waist deep. The employee sustained serious injuries. The employer did not protect employees from cave-in hazards.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c):  On or before October 20, 2025, the employer did not ensure that three employees working inside a trench that was approximately 9 feet deep and 20 feet in length to install utility lines were protected from cave-in hazards. A protective system was not utilized in the trench that had nearly vertical walls and spoils along each edge of the trench. One of the trench walls sloughed off, thus striking and trapping an employee waist deep. The employee sustained serious injuries.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into the excavation:  On or before October 20, 2025, the employer did not ensure that the spoil pile on either side of the trench was at least two feet from the edge. Three employees worked inside a trench that was approximately 9 feet in depth, 20 feet in length, had nearly vertical walls, and spoils on both sides of the trench were at the edge. The employer did not protect employees from cave-in hazards.
