On or about November 6, 2025, at the worksite located at 5840 Hwy 42 N, Sturgeon Bay, WI 54235, the employer had a set of stairs that led down to the water piping of the pool chemical room that was not equipped with a mid-rail on the open side of the stairs.

29 CFR  1910.146(c)(4): When the employer decided that its employees would enter permit spaces, the employer did not develop and implement a written permit space entry program that complied with 29 CFR 1910.146:  On or  about October 7, 2025, located at the pool at 5840 Hwy 42 N, Sturgeon Bay, WI 54235, employees were exposed to hazards of asphyxiation or engulfment when entering the holding tank of the pool.  The employer did not have a confined space program and elements as required by the standard.  All provisions of 29 CFR 1910.146 (c) through (l) must be covered in a written confined space program. Key elements include, but are not limited to the flowing:  1) An evaluation of the workplace to identify any and all permit required confined spaces 2) Informing employees of the existence of permit spaces, their locations, and the danger that they contain by posting danger signs 3) Create a PRCS Program that complies with all of the requirements of the standard. 4) Provide necessary equipment for evaluating spaces, entering spaces, and rescuing employees from spaces in emergencies. 5) Training all employees in their respective roles associated with Permit Required Confined Space entry.

29 CFR  1910.169(b)(3)(i):Air receivers were not equipped with one or more spring-loaded safety valves to prevent pressure in the receiver from exceeding the maximum allowable working pressure of the receiver by more than 10 percent:  On or  about October 25, 2025, located at the top shop at 5840 Hwy 42 N, Sturgeon Bay, WI 54235, employees were exposed to struck-by and explosion hazards when the Chicago Pneumatic Compressor (Model #CPS 900-150, S/N APP87878441) was connected to the drained 3,000 gallon water holding tank, to act as an air receiver in the winterization process.  The water tank, which was not equipped with a pressure relief valve, violently exploded when safe operating pressures of the tank were exceeded.

29 CFR  1910.242(a): Hand and portable powered tools or equipment were not kept in safe condition:  On or  about October 25, 2025, located at the top shop at 5840 Hwy 42 N, Sturgeon Bay, WI 54235, employees were exposed to struck-by and explosion hazards from the Chicago Pneumatic Compressor (Model #CPS 900-150, S/N APP87878441) that was operated with the pressure regulator set (142 PSI, or 9.79 BAR) above the safe operating limits of the downstream equipment (PVC piping and 3,000 gallon water tank).  During the winterizing process, the water tank, which was not equipped with a pressure release device, violently exploded when safe operating pressures of the tank were exceeded.
