29 CFR 1926.651(c)(2): Means of egress from trench excavations. A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees. a. On or about October 28, 2025, located at vicinity Francher Road and South County Line Road, Johnstown, Ohio 43031, the employer did not ensure employees had a means of egress within the open trench excavation when they performed water tie-in work in the excavation that was approximately 5 feet 7 inches deep, without a stairway, ladder, ramp or other safe means of egress. The condition exposed the employees to cave-in hazards as a result.

29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when: a. On or about October 28, 2025, located at vicinity Francher Road and South County Line Road, Johnstown, Ohio 43031, the employer did not ensure employees were protected from cave in hazards when they performed waterline tie-in work in an open excavation that was approximately 5 feet 7 inches deep. No means of cave-in protection was in place at the time the employees conducted the work inside of the trench. The condition exposed the employees to cave-in hazards a result.
