29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) 146 Janwich Street, Marlboro, NJ: A worker engaged in siding installation and other related activities fell from a height greater that 20 feet to the ground below while walking on and working on a roof of a residential structure without the use of fall protection on or about 10/28/2025. (b) 146 Janwich Street, Marlboro, NJ: A worker engaged in siding installation and other related activities were exposed to fall hazards, up to and more than 20 feet to the ground surface below while walking on and working on a roof of a residential structure without the use of fall protection. Condition noted on or about 10/29/2025. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: (a) 146 Janwich Street, Marlboro, NJ: Worker was exposed to fall hazards, up to and in excess of 10 feet to the ground surface below, when accessing to and egressing from a pitched roof using a portable ladder whose side rails did not extend at least 3 feet above the surface being accessed/egressed. Condition observed on or about 10/29/2025. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
