29 CFR 1910.134(c)(1): In any workplace where respirators are necessary to protect the health of the employees or whenever respirators are required by the employer, the employer did not establish and implement a written respiratory protection program with required worksite-specific procedures: (Construction Reference 1926.103)   a) On or about October 30, 2025, at the above addressed jobsite, the employer did not ensure that a written respiratory protection program was established for employees required to wear respiratory protection, including N95 disposable respirator and/or 3M 6000 Series tight-fitting half face respirators with particulate filter P100 (2097), when making adjustments during the installation of stone countertop and backsplashes.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR 1910.134(g)(1)(i)(A): Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function: (Construction Reference 1926.103)  a) On February 9, 2026, at 2001 York Road Suite 200, Oak Brook, IL, and employee was allowed to wear 3M 6000 Series tight-fitting half face respirators with particulate filter P100 (2097) when the employee had facial hair that came between the sealing surface of the facepiece and the face.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR 1926.1153(g)(1): The employer did not establish and implement a written exposure control plan:  a) On or about October 30, 2025, at the above addressed jobsite, the employer did not establish and implement a site specific written exposure control plan that outlined at least the following elements: a description of the tasks that can expose employees to respirable crystalline silica; a description of the engineering controls, work practices, and respiratory protection for each task; a description of housekeeping measures; and if  necessary, a description of the procedures to limit access to work areas to minimize employee exposure to crystalline silica.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
