29 CFR  1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.  a) Worksite located at 39 Ledgewood Avenue, Netcong, NJ 07857; new foundation level; two scaffolds located in the two new stairwell towers  On or about 10/29/2025, employees were exposed to fall hazards of approximately 12 feet from the working platforms of the 3-tier scaffolds to the ground below while performing masonry work without the use of fall protection.

29 CFR  1926.501(b)(6): Each employee on ramps, runways, and other walkways was not protected from falling 6 feet (1.8 m) or more to lower levels by guardrail systems:  a) Worksite located at 39 Ledgewood Avenue, Netcong, NJ 07857; Yard to exterior side of new foundation wall and on foundation level  On or about 10/29/2025, an employee was exposed to fall hazards of approximately 8 feet from the ramps/walkways, which were not equipped with guardrail systems, to the ground below. The ramps/walkways, which were made of planks, were used as access from the yard to top of the foundation wall.

29 CFR  1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.  a) Worksite located at 39 Ledgewood Avenue, Netcong, NJ 07857; Yard, new foundation level and stairwell towers  On or about 10/29/2025, employees were exposed to dust containing crystalline silica which was liberated when a handheld power saw was used to cut concrete blocks at the worksite. The employer failed to assess worker exposure to airborne crystalline silica to include implementing engineering controls (wet methods and shroud/dust collection system) during masonry activities.
