29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) Jobsite at or near 90-95 Snow Lane., Downingtown, PA - On or about October 10, 2025, the employer did not ensure employees engaged in residential construction activities 6 feet or more above lower levels was protected by guardrail systems, safety net system, or personal fall arrest system. Employees were performing roofing activities approximately 30 feet above ground level without the use of a fall protection system. b) Jobsite at or near 90-95 Snow Lane., Downingtown, PA - On or about October 21, 2025, the employer did not ensure employees engaged in residential construction activities 6 feet or more above lower levels was protected by guardrail systems, safety net system, or personal fall arrest system. Employees were performing roofing activities approximately 10 feet above next level without the use of a fall protection system. c)Jobsite at or near 130-131 Oberyn Lane., Downingtown, PA-On or about October 21, 2025, the employer did not ensure employees engaged in residential construction activities 6 feet or more above lower levels was protected by guardrail systems, safety net system, or personal fall arrest system. Employees were performing roofing activities on a porch approximately 15-16 feet above next level without the use of a fall protection system. Fernmoor Homes LLC was previously cited for a violation of this Occupational Safety and Health Standard, which was contained in OSHA inspection number 156300, citation number 1, item number1, and was affirmed as a final order on August 8, 2022, with respect to a workplace located at Lot 10 of the Liberty Development Millsboro, DE 19966.
