29 CFR  1910.180(d)(3): Deficiencies listed on frequent inspections were not carefully examined and a determination was not made as to whether they constituted a safety hazard:  a) 1 Yellowstone Club Trail, Big Sky, MT, Building 6: On or about November 11, 2025 and at times prior, the employer failed to ensure listed crane deficiencies regarding the Kenworth wheel mounted truck crane unit number 109143 were examined and addressed. The Daily Vehicle Inspection Report (DVIR) identified the loss of hydraulic pressure associated with the fork attachment and the employer did not make the determination to repair the crane prior to use. This condition exposed employees to unsafe operation and struck by hazards while utilizing the Kenworth wheel mounted truck crane.

29 CFR  1910.180(d)(4): "Periodic inspection." Complete inspections of the crane were not performed at intervals as generally defined in paragraph (d)(2)(ii) of this section depending upon its activity, severity of service, and environment, or as specifically indicated below. These inspections shall include the requirements of paragraph (d)(3) of this section and in addition, items such as the following. Any deficiencies such as listed shall be carefully examined and determination made as to whether they constitute a safety hazard:  (i)  Deformed, cracked, or corroded members in the crane structure and boom. (ii)  Loose bolts or rivets. (iii)  Cracked or worn sheaves and drums. (iv)  Worn, cracked, or distorted parts such as pins, bearings, shafts, gears, rollers and locking devices. (v)  Excessive wear on brake and clutch system parts, linings, pawls, and ratchets. (vi)  Load, boom angle, and other indicators over their full range, for any significant inaccuracies. (vii)  Gasoline, diesel, electric, or other power plants for improper performance or noncompliance with safety requirements. (viii)  Excessive wear of chain-drive sprockets and excessive chain stretch. (ix)  Travel steering, braking, and locking devices, for malfunction. (x)  Excessively worn or damaged tires.   a) 1 Yellowstone Club Trail, Big Sky, MT, Building 6: On or about November 11, 2025 and at times prior the employer did not perform complete inspections of the Kenworth wheel mounted truck crane, unit number: 109143, were not performed as required and/or any deficiencies listed in 29 CFR 1910.180(d)(4)(i)-(x) were not carefully examined and determination made as to whether they constitute a safety hazard. The employer did not verify  the Kenworth wheel mounted truck crane, unit number: 109143, that contained a hydraulic leak under the base of the crane was identified on the daily vehicle inspection report (DVIR). This condition exposed an employee to struck-by hazards.

29 CFR  1910.180(d)(3)(i):The employer did not verify control mechanisms for maladjustment interfering with the proper operation of crane control mechanisms during frequent inspections:  a) 1 Yellowstone Club Trail, Big Sky, MT, Building 6: On or about November 11, 2025 and at times prior, the employer did not verify that daily inspections were conducted of all control mechanisms for maladjustment interfering with proper operation. The Kenworth wheel mounted truck crane, unit number: 109143, had a mislabeled crane wireless remote (SCANRECO, Serial: 89512) that was not noted on inspections. the remote was used to offload items such as but not limited to: Drywall, DensShield, and Durock. This condition exposed employees to struck-by hazards.
