29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of the excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. Marin Ocean Terminal Concord (MOTCO), water main emergency repair, transfer pad between B & C: On or about November 13, 2025, and at times prior thereto the employer did not ensure that excavated materials kept 2 feet from the edge of the excavation to prevent it from falling into the excavation. This condition potentially exposed employees to falling excavated materials, tools and or equipment into the trench.

29 CFR 1926.652(a)(1):1926.652(a)(1): Employees were not protected in an excavation from a cave-in by an adequate protective system designed in accordance with paragraph (b) and (c) of this section. Marin Ocean Terminal Concord (MOTCO), water main emergency repair, between transfer pad B & C: On or about November 13, 2025, and at times prior thereto the employer did not provide cave-in protection for an employee who was working in the trench to locate and expose a vertical pipe that connects to a horizontal water main pipe. The trench was more than 5 feet deep in class C wet soil. This condition potentially exposed employee(s) to cave in hazards
