29 CFR  1926.21(b)(2):The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  On or about September 19, 2025, during a construction remodel project at a residential home located at 3358 E. 132nd St., Cleveland, OH 44120, the employer did not provide adequate instruction to employees on recognizing and avoiding unsafe conditions associated with the second-story balcony during the waste removal phase. As a result, employees were exposed to fall hazards of approximately 11.8 feet.

29 CFR  1926.501(a)(2):The employer did not determine if the walking/working surfaces on which its employees were to work had the strength and structural integrity to support employees safely:  On or about September 19, 2025, during a construction remodel project at a residential home located at 3358 E. 132ND ST., CLEVELAND, OH 44120, the employer did not ensure that the walking and working surface of the second-story balcony had the strength and integrity necessary to safely support employees and construction materials during the waste removal phase, thereby exposing employees to fall hazards of approximately  11.8 feet.

29 CFR  1904.39(a)(2):The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye.  On or about September 20, 2025, the employer did not report in-patient hospitalization to OSHA within 24 hours. An employee was hospitalized due to head, neck, and back injuries sustained from a fall of approximately 11.8 feet off a 2nd story balcony during a construction remodel project on a residential home located at 3358 E. 132ND ST., CLEVELAND, OH 44120.
