Employees were exposed to fall hazards in excess of 10 feet above the lower working surface. The fall hazards were created by the working platforms that were not fully planked or decked. This condition exposed employees to fall hazards in excess of 10 feet.

29 CFR  1926.451(c)(1): Supported scaffolds with a height to base width (including outrigger supports, if used) ratio of more than four to one (4:1) were not restrained from tipping by guying, tying, bracing, or equivalent means, as set forth in subparagraphs (i) - (iii) of this paragraph:  (a) On or about November 15, 2025, and at times prior, the employer did not ensure employees were not exposed to fall and crushing hazards in that the scaffold used to conduct brick laying operations was not braced to prevent tipping when the height to base ratio was greater than four to one (4:1). The end frames were five feet in width and six feet in height and five sections high which measured approximately 24 feet in overall height without tying guying to scaffolding system to the building under construction. This condition exposed employees to fall and crushing hazards.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface were not used. The cross braces were used as a means of access:  (a) On or about November 15, 2025, and at times prior, the employer did not ensure employees were not utilizing scaffold cross braces and frames as a means to access the working level, exposing them to falls of up to 24 feet. This condition exposed employees to fall hazards up to 24 feet.

Employees were exposed to falls, crushing and struck-by hazards while working on platforms not fully planked, without ladder access to elevated working platforms, lack of bracing, lack of fall protection and missing toe boards. This condition exposed employees to falls and crushing hazards.
