29 CFR  1910.178(a)(4): General requirements. Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly.  On or about November 18, 2025, with respect to an establishment located at N909 Midway Road, Hortonville, Wisconsin, the Heli forklift (Model No.: CPYD25-M1H, Serial No.: 230253A4407) was equipped with fork extensions which were not previously approved by the manufacturer, and which affected the capacity and safe operation of the vehicle. The capacity / operation plate was not updated to adjust the lifting capacity, exposing employees to tip over hazards.

29 CFR  1910.178(l)(6): Certification. The employer shall certify that each operator has been trained and evaluated as required by this paragraph (l). The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation.   On or about November 18, 2025, with respect to an establishment located at N909 Midway Road, Hortonville, Wisconsin, the employer did not certify that employees operating Heli forklift (Model No.: CPYD25-M1H, Serial No.: 230253A4407) had been trained and evaluated as required.

29 CFR  1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected.  On or about November 18, 2025, with respect to an establishment located at N909 Midway Road, Hortonville, Wisconsin,  the employer did not ensure that the Heli forklift (Model No.: CPYD25-M1H, Serial No.: 230253A4407) was inspected daily, exposing employees to potential struck-by hazards.

29 CFR  1910.132(d)(2): The employer shall verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment.  On or about December 9, 2025,  at an establishment located at N909 Midway Road, Hortonville, Wisconsin,  the employer did not verify that a workplace hazard assessment for the use of PPE had been conducted when employees were exposed to hazards that required equipment such as but not limited to safety glasses, safety shoes, respiratory protection, and protective sleeves.

29 CFR  1910.242(a): General requirements. Each employer shall be responsible for the safe condition of tools and equipment used by employees, including tools and equipment which may be furnished by employees.  On or about November 18, 2025, with respect to an establishment located at N909 Midway Road, Hortonville, Wisconsin, the employer failed to maintain Masterforce  angle grinder (Model No.: PGA115SU, Serial No.: 20231225), Craftsman angle grinder (Model No.: CMCG400),  and Tool Shop angle grinder (Model No.: TSAG66325) in a safe condition, in that employees utilized the angle grinders without the manufacturer installed guard in place.
