OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential crushing hazards from falling loads and/or lift parts:  a) Bay 1 (Closest to Office), Motorhead New York, LLC, 22154 US-11, Watertown, NY 13601, on or about 11/18/2025, a two-post surface mounted Forward Lift, SN NHE18G0003, was operated without being inspected and certified within the last 12 months. A vehicle was observed suspended from this lift while employees walked underneath it, and the safety latch had been disabled using a screwdriver.  b) Bay 2 (Middle Bay), Motorhead New York, LLC, 22154 US-11, Watertown, NY 13601, on or about 11/18/2025, a two-post surface mounted Mohawk Resources Ltd Lift, SN 701146, was operated without being inspected and certified within the last 12 months.   c) Bay 3 (Far side of Shop), Motorhead New York, LLC, 22154 US-11, Watertown, NY 13601, on or about 11/18/2025, a 4-post surface mounted Gemini Auto Lift, Model GR 12L, was operated without being inspected and certified within the last 12 months.

29 CFR  1910.303(b)(1):Electrical equipment was not free from recognized hazards that were likely to cause death or serious physical harm to employees:  a) Bay 1 (Closest to Office), Motorhead New York, LLC, 22154 US-11, Watertown, NY 13601, on or about 11/18/2025, The electrical breaker box did not have a dead front secured in place and all energized electrical connections were unguarded.  b) Bay 1 (Closest to Office), Motorhead New York, LLC, 22154 US-11, Watertown, NY 13601, on or about 11/18/2025, The electrical wire supplying powered to the  two-post surface mounted Forward Lift, SN NHE18G0003, had a splice that was not enclosed.   Abatement certification is required.

29 CFR  1910.303(g)(2)(i):Except as elsewhere required or permitted by Subpart S of Part 1910, live parts of electric equipment operating  at 50 volts or more were not guarded against accidental contact by use of approved cabinets or other forms of approved enclosures or by any of the means identified in paragraphs (A), (B), (C), and (D) of 29 CFR 1910.303(g)(2)(i):  a) Bay 1 (Closest to Office), Motorhead New York, LLC, 22154 US-11, Watertown, NY 13601, on or about 11/18/2025, The live parts of electrical breaker box were not guarded against accidental contact by used of approved cabinet or enclosure, the electrical breaker box did not have a dead front secured to it and all energized electrical connections were live and unguarded.  b) Bay 1 (Closest to Office), Motorhead New York, LLC, 22154 US-11, Watertown, NY 13601, on or about 11/18/2025, The electrical wire supplying powered to the  two-post surface mounted Forward Lift, SN NHE18G0003, had a splice that was not enclosed.
