29 CFR  1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use.  (a) Jobsite: On or about November 19, 2025, employees were required to use N95 respirators during dust-generating work, yet the employer had not established and implemented a written respiratory protection program with worksite-specific procedures addressing 29 CFR 1910.134(c)(1)(i)-(ix (including selection, medical evaluations, fit testing, use, maintenance, training, and program evaluation).

29 CFR 1910.134(g)(1)(i)(A): The employer did not prohibit a tight-fitting facepiece to be worn by employees who had facial hair that comes between the sealing surface of the facepiece and the face.  (a) Jobsite: On or about November 19, 2025, an employee performing dust-generating work was wearing an N95 tight-fitting filtering facepiece respirator while having facial hair along the sealing surface.

29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.  (a) Jobsite: On or about November 19, 2025, employees performed tasks listed on Table 1 of 29 CFR 1926.1153 yet the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for those tasks. This lack of implementation and assessment allowed Table 1 tasks to proceed without required controls or respiratory protection, placing employees at risk of respirable crystalline silica overexposure.
