29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: At the fabrication station of 270 Main Street, Suite C, Agawam, MA: On and before November 19, 2025, and at times prior, employees engaged in the fabrication of wood windows and door frames, and the employer had not administered a continuing, effective Hearing Conservation Program. One employee was exposed to 8-hour time-weighted average (TWA) sound levels of 90.1 decibels (dB) measured on the A scale, while operating and working in close proximity to noise-generating tasks associated with the manufacturing and production of wooden door and window trims using miter saws, staple, and nail guns.

29 CFR 1910.132(d)(2): The employer did not verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment: At the fabrication station of 270 Main Street, Suite C, Agawam, MA: On and before November 19, 2025, and at times prior, the employer had not verified, through a written certification, that an assessment to determine if hazards related, but not limited to, hazardous noise, wood dust, or hazardous chemicals, were present and necessitated the use of PPE to protect employees working in the fabrication, and production of, wood doors and window trim operations.
