29 CFR  1910.134(c)(2)(i):The employer did not provide respirator users with information contained in Appendix D to this section("Information for employees using respirators when not required under this standard") when voluntary respirator use was permissible:  On or about September 22, 2025 - SL Green Realty Corp located at 919 3rd Ave, New York, NY 10022  a) Employees who voluntarily used 3M N95 8210 and 8210V particulate respirators and 3M elastomeric half-face models were not provided with the information contained in 29 CFR 1910.134 Appendix D. The employer did not provide employees with the  Appendix D information.   NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASEFILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION NOR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19

29 CFR  1910.134(c)(2)(ii):The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user:   On or about September 22, 2025 - SL Green Realty Corp located at 919 3rd Ave, New York, NY 10022  a) Employees were provided with respirators such as but not limited to 3M elastomeric half -face respirators for voluntary use without receiving medical evaluation to determine respirator use. The employer did not ensure that employees voluntarily using tight-fitting respirators were medically able to use the respirator.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.

29 CFR  1910.1200(g)(8):The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and did not ensure that they are readily accessible during each work shift to employees when they are in their work area(s).   On or about September 22, 2025 - SL Green Realty Corp located at 919 3rd Ave, New York,  NY 10022   a) Employees use hazardous chemicals such as but not limited to Series MK09 Deck Shield Gloss Industrial Maintenance Coatings containing titanium dioxide, limestone, methyl ethyl ketoxine and an aromatic solvent. The employer did not maintain copies of the SDS for each chemical at the workplace.  NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASEFILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION NOR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19

The employer did not provide employees with effective training and information about the chemicals they work with.
