29 CFR  1910.1200(e)(1):The employer did not develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following:  (a)Dakota Rio, Inc dba Chevys Fresh Mex at 2801 South Louise Avenue, Sioux Falls, SD 57106: On or about and at times prior to November 19, 2025, the employer did not develop, implement and maintain a written hazard communication program covering hazardous chemicals used at the facility. This condition exposed employees to chemical hazards.

29 CFR  1910.1200(f)(6):The employer used written materials, such as signs, placards, process sheets, or batch tickets in lieu of affixing labels to individual stationary process containers that failed to identify the container(s) to which they were applicable and did not convey the information required by 29 CFR 1910.1200(f)(5):  (a)Dakota Rio, Inc dba Chevys Fresh Mex at 2801 South Louise Avenue, Sioux Falls, SD 57106: On or about and at times prior to November 19, 2025, the employer did not ensure chemical containers were labeled appropriately to convey information required by 29 CFR 1910.1200(f)(5). A unlabeled spray bottle of Medallion Stainless Steel Cleaner and Polish was found in the store area of the backroom. This condition exposed employees to chemical hazards.
