29 CFR 1910.145(c)(2)(ii) All employees shall be instructed that caution signs indicate a possible hazard against which proper precaution should be taken. (a) Hot Room (Fermentation Room) and Aromatics 2nd Floor Chutes: On December 12, 2025 and times prior, employer failed to instruct employees that caution signs indicated possible hazards from airborne nicotine against which proper precaution should be taken. Abatement certification required within 30 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.

29 CFR 1910.1200(g)(8): The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and did not ensure that they were readily accessible during each work shift to employees when they were in their work area(s). (a) Hot Room (Fermentation Room) and Aromatics 2nd Floor Chutes: On December 15, 2025 and times prior, employees were exposed to airborne nicotine when transferring material in and out of the Fermentation Room. The employer had not provided employees workplace copies of the required safety data sheets for nicotine. Abatement certification required within 30 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.
