29 CFR 1910.178(l)(1)(ii):Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5). a)On or about November 20, 2025, the employer failed to ensure that an employee had successfully completed the required powered industrial truck training and practical evaluation prior to operating a powered industrial truck. The employee operated a Hyster 50 Fortis, serial number P177V13082T, in the workplace without the employer first confirming completion of the training and evaluation.

29 CFR 1910.132(d)(2):The employer shall verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment. a) On or about November?20,?2025, the employer failed to ensure a workplace hazard assessment was completed and documented for employees working in the warehouse who were required to use foot protection. No written certification existed identifying the areas evaluated, the individual who performed the assessment, the date(s) of the evaluation, or documentation identifying the record as a hazard assessment certification.
