Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing for likely to cause death or serious physical harm to employees in that employees were exposed to:  a) On November 24, 2025, employees were exposed to struck by and caught between hazards when a foreman operating an JLG 1055 telehandler did not follow the manufactures load chart and overloaded the telehandler causing it to tip over.   Among other methods, feasible and acceptable means of abatement would include the following:   (1) Conform to the Association of Equipment Manufactures (AEM) Safety Manual for Operating and Maintenance Personnel, Section: Operate Safely. - "Refer to the trucks load capacity chart to determine the operating range in which you can safely lift, transport and place the load."   (2) Conform to the American National Standard Institute (ANSI) for Safety Standard for Rough Terrain Forklift Trucks, ANSI/ITSDF B56.1-2021, Paragraph 6.2, 6.4. - "Handle only loads within the capacity of the RTFL truck."   (3) Conform to the JLG 1055 Telehandlers Operations and Safety Manual, Section 1, 3 and 5.  - "DO NOT exceed rated lift capacity.", "The boom extension indicators (1) are located on the left side of the boom. Use these indicators to determine boom extension when using the capacity chart (see "Use of the Capacity Chart" on page 5-5).",  "To properly use capacity chart (see page 5-12)"   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.602(d): Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178:   29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):   a) On or about November 24, 2025, the employer did not train and evaluate employees operating the JLG 1055 telehandler.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.251(a)(2)(i): Employers did not ensure that rigging equipment had permanently affixed and legible identification markings as prescribed by the manufacturer that indicate the recommended safe working load:   a) On November 24, 2025, employees were using rigging that did not have identification markings that indicated the recommended safe working load.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
