OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to struck by and crushed-under hazards of vehicles falling from the automotive lift during its operation:   398 West Liberty Street, Wauconda, Illinois, Big Shop: On November 25, 2025, employees working under and around vehicles elevated with BendPak Two-Post Surface Mounted automotive lift (model, XPR 10ACX) were exposed to struck-by and crushed under-hazards of falling vehicles likely to result in death or serious injury. The employer did not ensure employees used this automotive lift with all four rubber-padded lift adapters installed on the swing arms when lifting low-profile vehicles such as 2005 BMW Series 330 CI for service. As a result, the vehicles were not effectively secured at their lift points for raising and lowering them on the automotive lift.   Among other methods, feasible and acceptable methods to correct this struck-by and crushed-under hazards would be to: Utilize another appropriate vehicle lifting device such a low-profile automotive floor jack with sufficiently rated and padded automotive jack stands; or Follow all of the instructions contained in the automotive lift manufacturer's literature supplied to the owner/user such as BendPak Two Post Surface Mounted Auto and Light Duty Truck lift installation and operations manual and BendPak Tech Bulletin TSB #07-21-10: "Operation Procedure Modification" which address lift operation safety and, among others, specifically warn to "Never use lift pad assemblies without rubber slip over pads in place"; and, "always position the lift adapters to contact  at the vehicle's manufacturer's recommended lift points. Raise lift until adapters contact vehicle. Check adapters for secure contact with vehicle. Always lift the vehicle using all four adapters."
