29 CFR 1910.134(e)(1): The employer shall provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace. The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator. a) On or about and at times prior to December 11, 2025, at the establishment located at 4811 West Michaels Drive, Appleton, Wisconsin; the employer did not provide a medical evaluation to determine each employee's ability to use a tight-fitting elastomeric respirator when required to be worn, exposing employees to the hazards associated inadequate physical/physiological capability. Employees wore half-face tight-fitting elastomeric respirators and a full-face tight-fitting elastomeric respirator.

29 CFR 1910.1025(d)(2): Each employer who has a workplace or work operation covered by this standard shall determine if any employee may be exposed to lead at or above the action level. a) On or about and at times prior to November 25, 2025, at the establishment located at 4811 West Michaels Drive, Appleton, Wisconsin; the employer did not determine if any employees may be exposed to inorganic lead at or above the action level while providing firearms instruction and cleaning the shooting ranges, where lead-containing bullets were fired, exposing employees to the hazards associated with inorganic lead.
