29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): Employees performing location preview and/or fireplace installation for Lumbermen's Brick & Supply Company at private residences were exposed to fall hazards in that the employer did not ensure employees working from roofs greater than 6 feet as measured from eave to ground were protected from falling to the next lower level. Instances included but were not limited to: i. On or about October 24, 2025, residential fireplace installation at 76848 NE Highway 47, Gothenburg, Nebraska, ii. On or about November 20, 2025, residential fireplace installation at 925 Q Road, Central City, Nebraska, iii. On or about November 20, 2025, residential fireplace installation at 1325 Sheridan Drive, Hastings, Nebraska, iv. 29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: On or about October 24, 2025, employees performing fireplace installation for Lumbermen's Brick & Supply Company at a private residence located at 76848 NE Highway 47, Gothenburg, Nebraska were exposed to fall hazards in that the employer did not ensure employees working from roofs greater than 6 feet as measured from eave to ground were trained to recognize fall hazards and the procedures to be followed to minimize those hazards prior to exposure.

29 CFR 1926.1053(b)(6): Unsecured ladder(s) were used on surfaces that were not stable and level: On or about October 24, 2025, employees performing fireplace installation for Lumbermen's Brick & Patio Company at a private residence located at 76848 NE Highway 47, Gothenburg, Nebraska were exposed to fall hazards in that employees utilized an extension ladder erected on a roof ridge to access a roof chimney that was approximately 20 feet from the roof peak to the next lower level.
