29 CFR 1910.132(d)(1): The employer shall assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). If such hazards are present, or likely to be present, the employer shall:  (i) Select, and have each affected employee use, the types of PPE that will protect the affected employee from the hazards identified in the hazard assessment;  (ii) Communicate selection decisions to each affected employee; and,  (iii) Select PPE that properly fits each affected employee.  On or about November 25, 2025, at an establishment located at N7720 Old Highway 141 in Crivitz, Wisconsin, in the repair shop, the employer did not sufficiently assess the workplace to determine if hazards were present, or likely to be present, which necessitated the use of personal protective equipment (PPE) in a vehicle repair shop. Such PPE includes, but is not limited to, hand protection and foot protection when employees are exposed to chemical absorption, and struck-by hazards to the hands, and feet.

Employers shall select and require employees to use appropriate hand protection when employees' hands are exposed to hazards such as those from skin absorption of harmful substances; severe cuts or lacerations; severe abrasions; punctures; chemical burns; thermal burns; and harmful temperature extremes.   On or about November 25,2025, at an establishment located at N7720 Old Highway 141 in Crivitz, Wisconsin, in the repair shop, the employer did not select and require mechanics to use appropriate hand protection during activities such as, but not limited to, cleaning parts in the part washer, filling windshield washer fluid, utilizing silicone lubrication sprays, and working inside vehicle motor areas with sharp edges and hot surfaces.

29 CFR 1910.305(g)(2)(iii): Flexible cords and cables shall be connected to devices and fittings so that strain relief is provided that will prevent pull from being directly transmitted to joints or terminal screws.  On or about November 25, 2025, at an establishment located at N7720 Old Highway 141 in Crivitz, Wisconsin, in the repair shop, the outer protective sheath on a flexible electrical cord was pulled away from the plug, exposing the internal conductors. The flexible cord was not provided strain relief at the outlet end of the cord to prevent pull from being directly transmitted to the joint.

Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also include the elements identified in sections 1910.1200(e)(i)-1910.1200(e)(ii).  On or about November 25, 2025, at an establishment located at N7720 Old Highway 141 in Crivitz, Wisconsin, in the repair shop, the employer did not develop, implement and maintain a Hazard Communication (HAZCOM) program for hazardous chemicals present and used in the workplace, including but not limited to, carbon monoxide, denatured alcohol, Power Service Bio Kleen, CAT extended life coolant extender,  Fleetguard cooling system cleaner, Power Service Diesel 911, 1st Ayd brake & metal parts cleaner,  Safety Kleen premium solvent, and DLX windshield washer anti-freeze and solvent. As a result, employees were exposed to chemical hazards such as, but not limited to, corrosives, flammable liquids and aerosols, target organ toxins (i.e., central nervous system, kidneys, etc.), sensitizers, and pressurized gases.   All provisions of 29 CFR 1910.1200(e) through (h) must be contained in a written hazard communication program. On or about November 25, 2025, at an establishment located at N7720 Old Highway 141 in Crivitz, Wisconsin, the employer did not ensure that labels on secondary chemical containers contained the product identifier and words, symbols, or combination thereof, which provided at least general information regarding the hazards of the chemicals. Such containers included, but were not limited to, the following:  a) A secondary container with "COOLANT" written on the side was not labeled or tagged with the product identifier and words, pictures, symbols, or a combination thereof, which provided information regarding the hazards of the chemical.   b) A secondary container with "HYD OiL"  written on the side was not labeled or tagged with the product identifier and words, pictures, symbols, or a combination thereof, which provided information regarding the hazards of the chemical.   c) A secondary container with "ELC GREEN"  written on the side was not labeled or tagged with the product identifier and words, pictures, symbols, or a combination thereof, which provided information regarding the hazards of the chemical.   d) Two secondary containers with "WASHER FLUID" written on the sides were not labeled or tagged with the product identifier and words, pictures, symbols, or a combination thereof, which provided information regarding the hazards of the chemical.   e) A Pepsi bottle containing dish soap was not labeled or tagged with the product identifier and words, pictures, symbols, or a combination thereof, which provided information regarding the hazards of the chemical.
