OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crush-by hazards: a) On or about November 25, 2025, throughout the COD warehouse, the employer did not furnish employment and a place of employment free from recognized hazards in that metal pallet storage racks were not anchored or bolted to the floor. This condition exposed employees to struck-by and crushing hazards while moving pallets of hoses and transmission part weighing 600 pounds with a forklift.

29 CFR 1910.178(e)(2): If the type of load presents a hazard, the user shall equip fork trucks with a vertical load backrest extension manufactured in accordance with paragraph (a) (2) of this section. a) On or about November 25, 2025, in the COD Warehouse, the employer did not ensure that the vertical load backrest was present when Mitsubishi Model FGC25N SN AF82F42458 forklift operators removed transmission parts and hoses from the pallet racks.
