Non-mandatory Appendix A to this subpart contains examples of criteria that will enable an employer to comply with paragraph (a) of this section. On or about November 19, 2025, at a jobsite located at N6132 15th Avenue in Wild Rose, Wisconsin; employees were exposed to fall hazards of approximately 8 to 9 feet while installing flashing on a 12-foot overhead door when the scaffold platform attached to a Sky Trak telehandler was not designed by a qualified person.

29 CFR 1926.451(f)(3): Scaffolds and scaffold components shall be inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity. On or about November 19, 2025, at a jobsite located at N6132 15th Avenue in Wild Rose, Wisconsin; employees were exposed to fall hazards of approximately 8 to 9 feet while installing flashing on a 12-foot overhead door when the scaffold platform attached to a Sky Trak telehandler was not inspected for visible defects by a competent person before each work shift. The retaining pin was missing and/or prone to falling out and several welds on the chain serving as a mid-rail were broken.

29 CFR 1926.602(c)(1)(ii): No modifications or additions which affect the capacity or safe operation of the equipment shall be made without the manufacturer's written approval. If such modifications or changes are made, the capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. In no case shall the original safety factor of the equipment be reduced. On or about November 19, 2025, at a worksite located at N6132 15th Avenue in Wild Rose, Wisconsin; a Sky Trak telehandler was equipped with a platform basket used to elevate employees approximately 8 to 9 feet above the ground surface while installing flash on a 12-foot overhead door. The basket attachment was not approved by the manufacturer and affected the capacity and safe operation of the vehicle. The capacity and operation plate was not updated to adjust the lifting capacity, exposing employees to fall hazards.
