29 CFR  1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc.   (a)  On or about October 23, 2025, the employer failed to provide one or more methods of machine guarding on the the Merry Go Round 1 (MGR1) drill and tap machine in the machine shop in that employees were able to manually load and adjust parts while the machine indexed and the drill operated. As a result, an employees suffered an amputation after being caught by the indexing machine.   (b)  On or about November 17, 2025, the employer failed to provide one or more methods of machine guarding on the Merry Go Round 1 (MGR1) drill and tap machine in the machine shop in that despite the installation of light curtains, employees were still able to reach into the point of operation while the machine indexed.  As a result, employees remained exposed to point of operation hazards.

29 CFR 1904.39(a)(2):  Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA.  (a)  On or about October 23, 2025, the employer did not report an employee amputation injury to OSHA within 24 hours of the occurrence.  The amputation injury was reported to OSHA on November 25, 2025, after Workers Comp told the employer they needed to report it.

29 CFR  1910.132(d)(2):The employer shall verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment.  (a)  On or about December 3, 2025, the employer failed to verify through a written certification that a workplace hazard assessment had been completed for the machine shop. No signed and dated certification identifying the workplace evaluated or the individual who performed the assessment was available.
