29 CFR  1910.28(b)(6)(i): The employer did not ensure that each employee less than 4 feet (1.2 m) above dangerous equipment is protected from falling into or onto the dangerous equipment by a guardrail system or a travel restraint system, unless the equipment is covered or guarded to eliminate the hazard.  a) 1101 Lambson Lane, New Castle, DE 19720: On or about December 2, 2025, employees exposed to falling into or onto while working less than 4 feet above the unguarded sorting platform conveyor band. Employee feel onto the sorting platform on 12/2/2025 resulting in serious injuries and hospitalization.

29 CFR  1910.147(c)(6): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirements of this standard are being followed.  The periodic inspection must: [A] be performed by an authorized employee other than the ones utilizing the energy control procedure being inspected.   [B] be conducted to correct any deviations or inadequacies identified. [C] where lockout is used for energy control, include a review, between the inspector and each authorized employee, of that employee's responsibilities under the energy control procedure being inspected. [D] where tag-out is used for energy control, include a review between the inspector and each authorized and affected employee, of that employee's responsibilities under the energy control procedure being inspected, and the elements set forth in paragraph (c)(7)(ii) of this section.   a) 1101 Lambson Lane, New Castle, DE 19720: On or about December 2, 2025 and days prior to and after, the employer did not ensure employees were provided with annual periodic inspections for LOTO procedures of the sorting platform conveyor band.

29 CFR  1910.147(e)(2)(i): Before lockout or tagout devices were removed and energy was restored to the machine or equipment, authorized employees did not ensure that all employees had been safely positioned or removed from the work area:  a) 1101 Lambson Lane, New Castle, DE 19720: On or about December 2, 2025, employees exposed to fall hazards of approximately twenty-one (21) feet when restored energy to the sorting platform conveyor band without an authorized employee checked to ensure all employees were safely positioned or removed from the work area.
