On or about November 26, 2025, employees working inside an excavation were exposed to struck by hazards from  dirt and rocks rolling off the spoil pile . Employees were not provided with head protection.

Protection by placing and keeping such materials or equipment at least 2 feet from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary was not provided.     (a) 5301 MS-145 Shubuta, MS. On or about November 26, 2025, Employees engaged in trenching/ excavating activities were exposed to engulfment hazards from the spoil pile being located at the edge of the open trench where employees worked exposing them to engulfment hazards.

29 CFR  1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person prior to the start of work, and as needed throughout the shift, for evidence of situations that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions.   a) 5301 MS-145 Shubuta, MS. On or about November 26, 2025, the employer did not ensure that a competent person conducted daily inspections of the excavation, adjacent areas, and protective systems prior to employee entry and as needed throughout the shift. Employees were exposed to cave-in hazards while working in a trench where hazardous conditions existed, including the absence of an adequate protective system and a spoil pile placed within two feet of the edge of the excavation.

On or about November 26, 2025, at 5301 MS-145, Shubuta, MS, employees were permitted to enter and work inside a trench over six feet in depth without the use of protective system such as sloping, benching, shoring, or a trench box, exposing the employee(s) to cave-in and engulfment hazards.
