29 CFR 1926.451(b)(1): Where the employer made a demonstration that a space wider than 1 inch was necessary between adjacent plank units and the platform and uprights, the platform was not planked or decked as fully as possible. a) At or near 151 Essex St., Hackensack NJ - Scaffold # 1- Ground Slab: Employees were exposed to fall hazards of approximately 6 feet while engaged in masonry activities utilizing a scaffold platform that was not fully planked around the opening where rebars from the column protruded, on or about 12/3/25. b) At or near 151 Essex St., Hackensack NJ - Scaffold # 2- Ground Slab: Employees were exposed to fall hazards of approximately 6 feet while engaged in masonry activities utilizing a scaffold platform that was not fully planked around the opening where rebars from the column protruded, on or about 12/3/25. c) At or near 151 Essex St., Hackensack NJ - Scaffold # 3- Ground Slab: Employees were exposed to fall hazards of approximately 6 feet while engaged in masonry activities utilizing a scaffold platform that was not fully planked around the opening where rebars from the column protruded, on or about 12/3/25.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access. a) At or near 151 Essex St., Hackensack NJ - Scafffold #1 - Ground Slab: Employees were exposed to fall hazards of approximately 6 feet while engaged in masonry activites utilizing a scaffold platform without proper means of access, on or about 12/3/25. b) At or near 151 Essex St., Hackensack NJ - Scafffold #2 - Ground Slab: Employees were exposed to fall hazards of approximately 6 feet while engaged in masonry activites utilizing a scaffold platform without proper means of access, on or about 12/3/25. c) At or near 151 Essex St., Hackensack NJ - Scafffold #3 - Ground Slab: Employees were exposed to fall hazards of approximately 6 feet while engaged in masonry activites utilizing a scaffold platform without proper means of access, on or about 12/3/25. Mr. Concrete Corp. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(e)(1), which was contained in OSHA inspection number 1801976, citation number 01, item number 03 and was affirmed as a final order on 7/14/25, with respect to a workplace located at 3716 John F Kennedy Blvd., Jersey City NJ.
