29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  a.  At a temporary commercial building construction site, located at 3434 Atlantic Boulevard, in Jacksonville, Florida: On or about December 4, 2025, the employer failed to provide a stairway, ladder, ramp, or other safe means of egress in a trench excavation that was four (4) feet or more in depth, in that employees were required to climb over pipes and the trench wall to enter and exit the excavation, rather than having a safe means of access located within twenty-five (25) feet of lateral travel.

29 CFR 1926.651(h)(1): Employees were working in excavations in which there was accumulated water, or excavations in which water was accumulating, and adequate precautions had not been taken to protect employees against the hazards posed by water accumulation:  a. At a temporary commercial building construction site, located at 3434 Atlantic Boulevard, in Jacksonville, Florida: On or about December 4, 2025, the employer exposed employees to hazards including cave-in, loss of footing, and drowning, in that employees were observed working inside an excavation containing approximately 11 inches of accumulated water, with running water actively entering the excavation from the excavation wall.

29 CFR 1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations, or by a combination of both if necessary:   a. At a temporary commercial building construction site, located at 3434 Atlantic Boulevard, in Jacksonville, Florida: On or about December 4, 2025, Employees were exposed to cave-in and struck-by hazards, in that excavated Class C soil, stored 6-inch PVC pipes and excavator equipment, were placed at the edge of an active trench while employees were working inside the excavation, and not maintained at least 2 feet from the excavation edge or otherwise restrained.

At a temporary commercial building construction site, located at 3434 Atlantic Boulevard, in Jacksonville, Florida: On or about December 4, 2025, the employer exposed employees to cave-in hazards, in that employees were allowed to work on a trench of approximated 6.2' depth without an adequate protective system such as sloping, shoring, or shielding.
