29 CFR 1926.102(a)(1):The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. a) On or about December 3, 2025, at a worksite located at EYA Townhomes Reservoir District 61 Service Road Washington DC; throughout the site, employees engaged in framing were not wearing eye protection provided while operating pneumatic tools such as nail guns or saws, exposing them to a struck-by hazard. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification. This documentation may include but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

This exposed them to the risk of falling while using the ladder through the wall openings, estimated fall of 27-feet.
