29 CFR  1910.134(c)(1):A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  (a) TDA Metals LLC, 405 Bell Street, Piscataway, NJ 08854/Employee(s) were provided and required to use battery-powered 3M Adflo filter units with helmets during the process of using the shear machine to cut catalytic converters into pieces as part of their daily activities, for which the employer did not have a written program for administering the use of respiratory protection in the workplace. Employee(s) were exposed to health hazard(s), including inhalation of metal dust.   Condition noted on or about 12/05/2025.

29 CFR  1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  (a) TDA Metals LLC, 405 Bell Street, Piscataway, NJ 08854/Employee(s) were provided and required to use battery-powered 3M Adflo filter units with helmets during the process of using the shear machine to cut catalytic converters into pieces as part of their daily activities. The employer did not provide a medical evaluation for employees to determine their ability to use a respirator before requiring employees to use them.   Condition noted on or about 12/05/2025.

TDA Metals LLC, 405 Bell Street, Piscataway, NJ 08854, throughout the facility/ Training and Evaluation was not done for employees operating Forklift Trucks. Training to include, but not limited to: -Truck safety related topics and workplace related topics to include company employees assisting in forklift operations and standing nearby.  -Evaluation of the operator's performance in the workplace. 29 CFR  1910.212(a)(3)(ii):Point(s) of operation of machinery were not guarded to prevent employee(s) from having any part of their body in the danger zone(s) during operating cycle(s):  (a)TDA Metals LLC/405 Bell Street, Piscataway, NJ 08854/The employer did not ensure that the McIntyre 407 CAT shear (Serial # 2036) in the warehouse was guarded to protect against crushing and amputation injuries.  The ingoing nip points created by the McIntyre 407 CAT shear had a guard in the open position while operating which did not prevent employees from accessing the zone of danger.  Condition occurred on or about 12/05/2025.
