29 CFR  1903.19(c)(1):The employer did not certify to OSHA, within 10 calendar days after the abatement date, that the cited violation had been abated:  (a) R&R Exterior and Interior, Inc., failed to certify abatement within 10 calendar days after the abatement date that each of the following cited violations had been corrected:   Citation 1, Item 1 a serious violation of 29 CFR 1926.100(a) with an abatement date of February 19, 2026.  Citation 1, Item 2 a serious violation of 29 CFR 1926.102(a)(1) with an abatement date of February 19, 2026.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATIONS OF THE CORRECTIVE ACTION WORKSHEET).

(a) R&R Exterior and Interior, Inc., failed to document abatement within 10 calendar days after the abatement date that each of the following cited violations had been corrected:   Citation 1, Item 3 serious violation of 29 CFR 1926.300(b)(4)(ii) with an abatement date of February 19, 2026.  Citation 1, Item 4 serious violation of 29 CFR 1926.451(g)(1) with an abatement date of February 19, 2026.  Citation 1, Item 4 a serious violation of 29 CFR 1926.454(a) with an abatement date of February 19, 2026.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATIONS OF THE CORRECTIVE ACTION WORKSHEET).

29 CFR  1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  (a) On or about December 8, 2025, employees were performing clean up on the ground without a hard hat on, while other employees were working from a ladder jack scaffolding installing siding and throwing debris from the scaffold above to the ground below, exposing the employees to a struck-by hazard.

29 CFR  1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level was not protected from falling to that lower level.  (a)  On or about December 8, 2025, employees were installing siding on the exterior of an apartment complex, using a ladder jack scaffold, were not protected from falling to the lower level. This exposed employees to a fall hazard of approximately 15 feet on the back side of the apartment complex, and 13 feet on the front side of the apartment complex.

29 CFR  1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.  (a)  On or about December 8, 2025, employees were replacing siding on the exterior of an apartment complex, using a ladder jack scaffold, had not been trained on the hazards associated with scaffold work. This exposed employees to fall hazards of approximately 15 feet on the back side of the apartment complex and 13 feet on the front side of the apartment complex.
