29 CFR 1926.501(b)(13): Employees engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a)Builders FirstSource at 530 Denali Drive, Box Elder, SD 57719: On or about and at times prior to December 8, 2025, the employer did not ensure that an employee was protected from falls while conducting shingle loading operations on a single-family residential structure. This condition exposed the employee to fall hazards greater than six feet.

29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them: (a)Builders FirstSource at 530 Denali Drive, Box Elder, SD 57719: On or about and at times prior to December 8, 2025, the employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the jobsite, materials, and equipment; conducted by a competent person. An employee was conducting various construction operations on a residential property while exposed to fall hazards, ladder hazards, and inadequate training. This condition exposed employees to various hazards while on construction sites.
