29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. a.) On or about December 8, 2025, the employer failed to ensure that frequent and regular inspections were conducted by a competent person, in that the employer did not identify that employees were performing lifts using free rigging from the forks of a JLG SkyTrak all terrain forklift without the manufacturer's approval. Employees were guiding and positioning a 25 foot light pole while the forklift supported the suspended load using slings hung directly from a single fork. As a result, employees were exposed to struck by and crushed by hazards from the load shifting or falling from the forklift.

29 CFR 1926.602(c)(1)(ii):No modifications or additions which affect the capacity or safe operation of the equipment shall be made without the manufacturer's written approval. If such modifications or changes are made, the capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. In no case shall the original safety factor of the equipment be reduced. a.) On or about December 8, 2025, located on the Paragon Ranch construction job-site the employer failed to attain the manufacturers written approval on a JLG "Skytrak" all terrain forklift that was modified in use affecting the safe operations by free-rigging off of the forks to set street parking light post within the residents parking lot. As a result, employees were exposed to struck-by and crushing hazards from the unstable load and potential equipment tip-over.
