29 CFR 1926.300(b)(2): Moving part(s) of equipment exposed to contact by employees or which otherwise created a hazard, were not guarded: a) New residential construction on Lot #40: On December 10, 2025, employees were exposed to amputation and severe laceration hazards. The abrasive cut-off saw used for cutting bricks had its lower blade guard rendered inoperable because it was tied back, preventing the guard from functioning as designed.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access. a) Supported scaffold: On 12/10/25, the employer exposed employees to fall hazards of up to 15-feet in that no safe means of access/egress was provided to employees while entering or exiting the supported scaffold system.

29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section. a) On or about December 10, 2025, at the new residential construction site on Lot #40, employees were exposed to respirable crystalline silica hazards while dry cutting brick outdoors. The employer failed to implement the engineering controls required by Table 1, such as using a saw designed for wet cutting, resulting in exposure to silica dust and a respiratory health hazard.
