OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employees were exposed to struck-by and crushing hazards from collapsing storage racks due to missing bolts to secure the racks:  (a) Establishment, Warehouse area - On or about December 11, 2025, employees were exposed to struck-by and crush-by hazards while performing work activities such as, but not limited to operating powered industrial trucks (PIT) to move pallets of materials,  such as event lighting and event supplies, on and off of Interlake steel storage rack systems.  The employer did not ensure that all of the base plates of the rack columns (posts) were anchored to the warehouse floor with anchor bolts to prevent the racks from collapsing from PIT impacts or loading/unloading forces.

29 CFR  1910.22(a)(3):29 CFR 1910.22(a)(3): The employer did not ensure that walking-working surfaces are maintained free of hazards such as sharp or protruding objects, loose boards, corrosion, leaks, spills, snow, and ice:  (a) Establishment, Parking Lot - On or about December 10, 2025, employees were exposed to slip, trip, and fall hazards while working in an area where the snow and ice had not been removed. The employees were assigned to load a flatbed trailer with large stage trusses and had no means to remove the snow and ice to safety load the trailer.

29 CFR  1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:  (a) Establishment, Warehouse Area - On or about December 11, 2023, employees were operating a battery-operated Caterpillar forklift, model EC20KS-C40. There were no means available to quickly drench or flush the eyes and body within the work area for emergency use, as the eyewash station was located approximately 150 feet from the forklift repair area.

29 CFR  1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a powered industrial truck:   (a) Establishment, Warehouse Area - On or about December 11, 2025, employees were tasked with operating a Toyota forklift model number 8FBCU25, Piggy back loader model number D50qefodsuadpa, and a Caterpillar forklift model EC20KS-C40 in the warehouse area without successfully completing the required training and evaluation.

29 CFR  1910.178(q)(1): Any power-operated industrial truck not in safe operating condition was not taken out of service, and/or repairs were not made by authorized personnel:   (a) Establishment, Warehouse Area - On or about December 11, 2025, employees were operating a Toyota forklift, model number 8FBCU25, in the warehouse area. The forklift had a broken forward-facing headlight and a missing parking brake rubber cover. As a result, the forklift was not in safe operating condition for employees to use safely.
