29 CFR 1926.651(h)(1):Employees shall not work in excavations in which there is accumulated water, or in excavations in which water is accumulating, unless adequate precautions have been taken to protect employees against the hazards posed by water accumulation. The precautions necessary to protect employees adequately vary with each situation, but could include special support or shield systems to protect from cave-ins, water removal to control the level of accumulating water, or use of a safety harness and lifeline. On or about December 16, 2025, accumulating water was not removed from a trench during directional boring operations, exposing the employee to the hazards associated with accumulating water. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.651(k)(2):Where the competent person finds evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees shall be removed from the hazardous area until the necessary precautions have been taken to ensure their safety. On or about December 16, 2025, the competent person failed to recognize an employee engaged in trenching work was exposed to the hazards associated with with using a directional boring machine without the required ground attachment. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
