1910.132(d)(1) The employer did not assess the workplace to determine if hazards were present, or were likely to be present, which necessitated the use of personal protective equipment: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to struck by injuries while performing temporary traffic control operations in roadways where the traffic was exposed to extreme solar glare. White Oak Hill Road - On December 16, 2025, an employee sustained serious injuries when struck by a vehicle in a work zone while providing flagging services for tree clearing operations, as the operator of the vehicle was blinded by solar glare. The hazard was identified by employees prior to the event and work was permitted to continue despite the known risk.
