29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) On or before December 16, 2025, the controlling employer did not ensure that subcontracting employees were protected from injury, in that employees were accessing and egressing the two story, multi-family residential building using a metal extension ladder that was extended to to the gutter. The ladder was not secured and only extended 2 rungs or 24 inches above landing. This condition exposed the employees to a fall in excess of 6 feet.

29 CFR 1926.1053(b)(22): Employees using ladders were carrying objects or loads that could cause the employee to lose balance and fall: (a) On or before December 16, 2025, the controlling contractor did not ensure that subcontractor employees were protected from injury, in that employees were accessing and egressing the two story, multi-family residential building via a 12 ft metal extension ladder that was extended to a range of 19.6 ft to the gutter. Employees were seen observed accessing and egressing the ladder with tools and materials in their hands. This condition exposed the employee to a fall in excess of 6 feet.
