29 CFR 1910.1001(j)(3)(i): The building owner, facility owner, or employer did not determine the presence, location, and quantity of ACM or PACM at the worksite and did not exercise due diligence in complying with these requirements to inform employers and employees about the presence and location of asbestos-containing material (ACM) and presumed asbestos containing material (PACM): At the veterinary facility located at 411 SW Market Street in Lee's Summit, Missouri 64063, on or about December 18, 2025, and at times prior: The employer did not conduct an environmental assessment to identify the presence, location and quantity of ACM and PACM in the facility. Flooring and ceiling remodeled previously had been PACM, there was also some new pipe and duct work done that was believed to be ACM.

At the veterinary facility located at 411 SW Market Street in Lee's Summit, Missouri 64063, on or about December 18, 2025, and at times prior: The employer did not maintain copies of all building records required by this section, but not limited to environmental survey assessments to determine the presence, location and quantity of ACM and PACM in the facility.
