29 CFR  1926.1101(f)(2)(i): Each employer who has a workplace or work operation covered by this standard shall ensure that a "competent person" conducts an exposure assessment immediately before or at the initiation of the operation to ascertain expected exposures during that operation or workplace. The assessment must be completed in time to comply with requirements which are triggered by exposure data or the lack of a "negative exposure assessment," and to provide information necessary to assure that all control systems planned are appropriate for that operation and will work properly.  At the veterinary facility located at 411 SW Market Street in Lee's Summit, Missouri 64063, on or about December 18, 2025, and at times prior: Employees were exposed to particulates during demolition and remodeling work when the employer's competent person did not conduct an environmental assessment of the facility before the work started. The employer did not ensure that the areas to be remodel were tested to ensure there were no ACM or PACM on site.

Building/facility owners whose employees perform such work did not comply with the provisions located in (k)(3)(i) through (k)(3)(iii) to the extent applicable:  At the veterinary facility located at 411 SW Market Street in Lee's Summit, Missouri 64063, on or about December 18, 2025, and at times prior: The employer did not comply with the requirements of this standard by identifying the presence, location and quantity of ACM and PACM in the facility. Flooring and ceiling remodeled previously had been PACM. Employees were exposed to particulates during demolition and remodeling work without a determination of whether asbestos was present.
