29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a - Dividing Wall Between 172 & 174 Leona Stewart Lane, Pennington NJ: A company worker was exposed to fall hazards, in excess of 8 feet to the flooring below, when walking and standing on the top plates of residential structure's second floor wall frame without fall protection. Condition observed on or about 12/18/25. b - 170 & 172 Leona Stewart Lane, Pennington NJ: A company worker was exposed to fall hazards, in excess of 9 feet to the flooring below, while working and walking at and near the unprotected edges of a residential structure's second floor without fall protection. Condition observed on or about 12/18/25.

29 CFR 1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii) a- 170, 172 & 174 Leona Stewart Lane, Pennington NJ: Company workers were exposd to fall hazards when walking and working at and near unprotected edges and from the top plates of wall frames while not using fall protection. These workers had not received training regarding the identification, elimination, etc. of fall hazards by a competent person. Condition observed on or about 12/18/25. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
