29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles:   a) New construction located on Lot #60 at 5866 Cabernet Lane, Braselton, GA, at the Vines at Mill Creek subdivision: the employer exposed employees to struck-by hazards while operating pneumatic nail guns, in that protective eyewear was not provided while operating these tools at 110 PSI while engaged in framing activities.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   a) New construction located on Lot #60 at 5866 Cabernet Lane, Braselton, GA, at the Vines at Mill Creek subdivision, top plate: the employer exposed employees to fall hazards of up to 19-feet, 3-inches from the to plate to the lower level in that a fall protection system was not provided during framing operations.  b) New construction located on Lot #60 at 5866 Cabernet Lane, Braselton, GA, at the Vines at Mill Creek subdivision, unprotected back wall; the employer exposed employees to fall hazards of 10-feet to the lower level from the first floor in that a guardrail was not erected at the 18-foot,2-inch wide opening.  c) New construction located Lot #60 at 5866 Cabernet Lane, Braselton, GA, at the Vines at Mill Creek subdivision, unprotected basement hole; the employer exposed employees to fall hazards of 9-feet, 5-inches to the lower concrete level from the first floor in that a guardrail was not erected at the "L-shaped" floor opening approximately 3-foot X 3-foot long.

29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed:  a) New construction located on Lot #60 at 5866 Cabernet Lane, Braselton, GA, at the Vines at Mill Creek subdivision, employees were exposed to a fall hazard of approximately 9 feet 5 inches while using a 6-foot A-frame step ladder for access and egress during framing activities. The ladder was not designed for this purpose, and a taller ladder was not provided, requiring employees to stand on the top step to transition to the top plate.
