29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: At a worksite located at 9200 NW 112th Street, Kansas City, MO 64153: Employees were exposed to the following hazards that included, but were not limited to potential asbestos containing materials and/or asbestos containing materials. The employer failed to establish and implement a written respiratory program for voluntary and/or required use of respirators. This was demonstrated on or about December 10, 2025, when the employer had employees using respirators as part of a clean-up process of damaged flooring tile related to a remodeling project after old carpet had been removed.

29 CFR 1910.134(e)(2)(i): The employer did not identify a physician or other licensed health care professional (PLHCP) to perform medical evaluations using a medical questionnaire or an initial medical examination that obtained the same information as the medical questionnaire: At a worksite located at 9200 NW 112th Street, Kansas City, MO 64153: Employees were exposed to the following hazards that included, but were not limited to potential asbestos containing materials and/or asbestos containing materials. The employer failed to identify a physician or other licensed health care professional (PLHCP) to perform medical evaluations using a medical questionnaire or an initial medical examination that obtained the same information for the voluntary and/or required use of respirators. This was demonstrated on or about December 10, 2025, when the employer had employees using respirators as part of a clean-up process of damaged flooring tile related to a remodeling project after old carpet had been removed. The employer had employees perform a self assessment in a mini medical questionnaire that was not reviewed by a physician or other licensed health care professional (PLHCP).

29 CFR 1910.132(d)(2): The employer did not verify, through a written certification, the identity of the workplace evaluated, the person certifying that the evaluation had been performed, and the date the hazard assessment was done: At a worksite located at 9200 NW 112th Street, Kansas City, MO 64153: Employees were exposed to the following hazards that included, but were not limited to physical safety hazards and health related hazards, including the potential exposure to asbestos-containing materials. The employer failed to formally assess and certify that the workplace had been evaluated, when it had been evaluated and by whom. This was demonstrated on or about December 10, 2025, when the employer had failed to produce a written certification that verified that a personal protective equipment (PPE) assessment had taken place at the facility for all potential activities taking place therein.
