29 CFR  1910.107(g)(2): All spraying areas were not kept as free from the accumulation of deposits of combustible residues as practical, with cleaning conducted daily if necessary:  At the old and new  spray paint booths, spray-painter employees are exposed to fire hazards. Accumulation of combustible residues of spray painting, hardener and primer were observed in the interiors of the booth. Cleaning is not conducted as necessary. According to the safety data sheet of the Sherwin Williams  yellow paint, hardener and primer are flammable liquids and vapors.

29 CFR  1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  At the old and new paint booths, employees are exposed to pulmonary hazards and/or cardiac stress hazards when using required respirators without having been provided a medical evaluation prior to use. The employer requires spray-painters employees to wear 3M full-face filtering respirators when spray painting and have not been medical evaluated. No medical evaluation records were provided.

29 CFR  1910.1200(f)(6)(ii): Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical.  Employees in the production, pre-assembly and spray painting booth areas were exposed to chemical hazards when using unlabeled chemical containers: 1) An unlabeled spray bottle containing Windex was observed at the production area. According to the safety data sheet, it causes serious eye irritation. 2) Four unlabeled spray bottles containing either, soap and water, water and WD-40 and an unlabeled gallon containing motor oil was observed at  the pre-assembly area. According to the safety data sheets, WD-40 is an extremely flammable aerosol, may be fatal if swallowed and enters airways and may cause drowsiness or dizziness. 3) One unlabeled metallic container with methyl ethyl ketone (MEK) was observed at the old paint booth. According to the safety data sheet, it is highly flammable liquid and vapor, causes serious eye irritation and may cause dizziness or drowsiness.

29 CFR  1910.1200(h)(3):The employee training did not include the requirements of 29 CFR 1910.1200(h)(3)(i) through (h)(3)(iv):  Employees in the production, pre-assembly and spray painting booth areas were exposed to chemical hazards when using chemicals such as but not limited to: Sherwin William yellow paint, hardener, primer, gloss, WD-40 and motor oil. According to the safety data sheets, these can cause serious eye irritation, have high flammability, drowsiness and/or dizziness. Employees did not demonstrate knowledge of the location of the safety data sheets in the facility and the chemical container labeling requirements.
