29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to a safe operating condition. Establishment: On or about December 23, 2025, the employer failed to remove a forklift from service that was equipped with an inoperable emergency brake, inoperable reverse light and an inoperable horn. An employee suffered severe crushing injuries when an emergency brake did not hold a forklift that was left in gear from rolling forward.
